When an adult who grew up in care requests their file, they are often looking for answers about their own life — why decisions were made, who their family were, what happened to them. The response has to balance two things at once. The requester is entitled to their own information, and in these cases it can matter enormously. But information about birth parents and siblings is their personal data too, and has to be assessed under the third-party test rather than released or withheld wholesale.

Social workers and other professionals acting in a professional role are generally not protected in the same way as family members. Their names and actions will usually be disclosable.

The social work serious harm test

Social work records have their own exemption under the Data Protection Act 2018. Information can be withheld where disclosure would be likely to prejudice the carrying out of social work by causing serious harm to the physical or mental health of the requester or someone else.

That is a high bar, and it applies to specific information, not to a file as a whole. Where it is used, the decision and reasoning should be recorded. Offering support when a care file is released — a covering letter, or a meeting to go through it — is widely regarded as good practice.

Frequently asked questions

How long does a care leaver SAR take?

The statutory deadline is one month, extendable by up to two further months where a request is complex. Large care files often justify the extension, but it must be notified to the requester within the first month with a reason. Starting the search immediately is what keeps these on track.

Can we withhold information about a care leaver's birth family?

Not automatically. Information about birth parents and siblings is their personal data, so each item must be assessed under the third-party test — considering confidentiality, consent and whether disclosure is reasonable. Some will be released and some withheld, with every decision recorded.

Is CCTV footage included in a SAR?

Yes, where the requester can be identified in it and the footage still exists. Other people in frame usually need to be blurred or removed before release.
